Moving Tote Rental Agreement & Terms and Conditions

By placing an order, accepting delivery, taking possession of rental equipment, or accepting these terms electronically, you ("Customer") agree to the following Terms and Conditions with Elevation Rentals ("Company").

1. Rental Equipment

Equipment may include, but is not limited to:

  • Moving Totes
  • Dollies
  • Tote Labels
  • Packing Accessories
  • Other rental equipment supplied by Elevation Rentals.

All equipment remains the exclusive property of Elevation Rentals at all times.

Equipment Appearance & Substitutions

Product photos on the Elevation Rentals website are provided as a general representation of the rental equipment.

The equipment provided may vary in colour, brand, design, appearance, or minor physical features from the equipment shown in product photos.

Where a substitution is made, Elevation Rentals will provide equipment with the same or comparable intended function, capacity, and general specifications as the equipment reserved.

For example, a dolly may be a different colour or design, or a cooler may have minor differences in features such as handle or wheel placement.

These cosmetic or minor design differences do not constitute a change to the Customer's reservation, provided the substituted equipment offers substantially equivalent functionality and capacity.

2. Rental Period

The rental period begins at the scheduled delivery or pickup date and time and ends on the agreed return or collection date.

Extensions are subject to inventory availability and must be approved before the original return date.

Unauthorized extensions may result in additional rental charges.

3. Booking & Payment

A booking is confirmed once:

  • Payment has been received (if applicable)
  • Any required security deposit has been received
  • Elevation Rentals confirms the reservation

Rental balances must be paid before delivery unless otherwise agreed in writing.

4. Security Deposit

Elevation Rentals may require a refundable security deposit.

The security deposit may be used toward:

  • Lost equipment
  • Damaged equipment
  • Excessive cleaning
  • Late returns
  • Collection costs

Unused portions of the security deposit will be refunded following inspection.

5. Delivery & Pickup

Customers agree to provide:

  • Safe and reasonable access to the delivery and pickup locations.
  • Accurate delivery and pickup information.
  • A valid phone number where the Customer can be reached regarding delivery and pickup.
  • Someone available during scheduled delivery or pickup when required.

Rental equipment may be collected from either the original delivery address or an alternate pickup address provided by the Customer.

Alternate pickup addresses must be within Elevation Rentals' 100 km service area and must be confirmed with Elevation Rentals prior to the scheduled pickup.

Pickup from an alternate address located within 50 km of Elevation Rentals will not incur an additional distance fee.

Alternate pickup addresses located more than 50 km and up to 100 km from Elevation Rentals will be subject to an additional pickup fee of $2.00 per kilometer for each kilometer beyond the included 50 km service range.

Elevation Rentals will confirm any applicable additional pickup fee with the Customer after the alternate pickup address has been provided and before the scheduled pickup.

Delivery or pickup delays caused by inaccessible locations, incorrect or incomplete addresses, customer absence, or unreported address changes may be subject to additional charges.

Customers remain responsible for all rental equipment until it has been physically collected by Elevation Rentals.

6. Customer Responsibilities

Customers agree to:

  • Use equipment only for its intended purpose.
  • Protect equipment from theft or damage.
  • Keep equipment in a secure location.
  • Report damaged or missing equipment immediately.
  • Return all equipment clean and empty.

Customers are responsible for anyone using the rented equipment during the rental period.

7. Proper Use of Moving Totes

Moving totes are designed for transporting and temporarily storing household or office contents.

Customers agree NOT to use totes for:

  • Chemicals
  • Paint
  • Fuel
  • Oils
  • Hazardous materials
  • Explosives
  • Illegal substances
  • Live animals
  • Perishable food
  • Wet materials likely to cause mold
  • Any material capable of permanently staining or damaging the tote

8. Weight Limits

Customers agree not to overload totes beyond their intended capacity.

Damage resulting from overloading is the responsibility of the customer.

9. Labels & Markings

Only removable labels supplied or approved by Elevation Rentals should be applied.

Customers agree not to:

  • Paint totes
  • Spray paint totes
  • Apply permanent stickers
  • Use permanent markers
  • Drill, cut, or modify equipment

10. Cleaning

Normal cleaning is included.

Additional charges may apply if equipment is returned with:

  • Dirt
  • Mud
  • Food residue
  • Adhesive residue
  • Paint
  • Oil
  • Chemicals
  • Mold
  • Animal waste
  • Smoke odor
  • Strong odors requiring additional cleaning

11. Damage & Loss

Customers are responsible for repair or replacement costs resulting from:

  • Broken totes
  • Broken lids
  • Missing lids
  • Missing totes
  • Damaged dollies
  • Theft
  • Fire
  • Flood
  • Negligence

Replacement charges are based on the current replacement value of the equipment.

12. Inventory Verification

Elevation Rentals reserves the right to inspect and inventory all equipment upon delivery and return.

Photos and videos may be taken to document:

  • Equipment condition
  • Equipment quantity
  • Existing damage

These records may be used in the event of a dispute.

13. Late Returns

Late returns may be charged at the applicable daily or weekly rental rate.

Equipment not returned within thirty (30) days may be considered permanently lost.

Replacement charges may then apply.

14. Authorization to Charge Payment Method

The Customer authorizes Elevation Rentals to charge the payment method on file for:

  • Approved rental extensions
  • Late fees
  • Cleaning fees
  • Damage charges
  • Missing equipment
  • Replacement costs
  • Additional delivery or pickup fees resulting from an approved change in delivery or pickup location

Where an additional pickup fee applies due to an alternate pickup address, Elevation Rentals will advise the Customer of the applicable fee before the charge is processed.

Supporting documentation will be provided upon request.

15. Cancellation Policy

Cancellations made:

  • More than 72 hours before delivery will receive a full refund.
  • Less than 72 hours before delivery may be subject to a cancellation fee.

Weather does not automatically qualify for cancellation unless approved by Elevation Rentals.

16. Limitation of Liability

Elevation Rentals is not responsible for:

  • Damage to items stored inside totes
  • Improper loading by customers
  • Injury resulting from misuse
  • Business interruption
  • Indirect or consequential damages

Customers assume responsibility for the safe use of all rented equipment.

17. Indemnification

The Customer agrees to indemnify and hold harmless Elevation Rentals, its owners, employees, contractors, and affiliates from any claims, losses, damages, costs, or legal expenses arising from the Customer's possession or use of the rented equipment.

18. Force Majeure

Elevation Rentals shall not be liable for delays or failure to perform due to events beyond its reasonable control, including but not limited to severe weather, road closures, natural disasters, labor disruptions, government actions, or other unforeseen events.

19. Privacy

Customer information is collected only for the purposes of processing reservations, providing rental services, communicating with customers, and meeting legal or business obligations.

Elevation Rentals does not sell customer information to third parties.

20. Governing Law

This Agreement shall be governed by the laws of the Province of Alberta and the applicable laws of Canada.

21. Changes to These Terms

Elevation Rentals reserves the right to update these Terms and Conditions at any time. The version in effect at the time of booking will apply to that rental unless otherwise required by law.

22. Entire Agreement

These Terms and Conditions constitute the entire agreement between the Customer and Elevation Rentals regarding the rental of equipment and supersede any prior verbal or written agreements related to the rental.

23. Acceptance

By placing an order, electronically accepting these Terms and Conditions, signing a rental agreement, or taking possession of rental equipment, the Customer confirms that they have read, understood, and agree to be bound by these Terms and Conditions.
